Clarity Labs, LLC  (“CL”) is committed to compliance with the wide range of federal and state  regulatory  requirements, including, without  limitation, the Health Insurance Portability and Accountability Act (“HIPAA”), the Clinical Laboratory Improvement Act (CLIA) the Federal Anti-Kick back Statute and the Stark Law. These laws, while complex, relate primarily to

relationships between CL and referral sources, including physicians.

 

CL has taken and continues to pursue specific, identifiable steps to demonstrate that commitment. CL concurs with the Office of the Inspector General (OIG) of the United States that patient care is, and should be, the first priority. However, focus on patient care can be enhanced by the adoption of a voluntary compliance program.

 

For  example, the increased accuracy of documentation that results from a compliance program actually enhances patient care. CL also agrees that the benefits of a well-designed compliance program (as outlined in the October 5, 2000 Federal Register) are as follows:

 

  1. To speed and optimize proper payment of claims
  2. To minimize billing mistakes
  3. To reduce the chances that an audit will be conducted by CMS or the OIG, and
  4. To avoid conflicts with self-referral and anti-kickback statutes.

 

A Compliance Program is a major initiative of CL to prevent submission of erroneous claims and to combat fraudulent conduct through the use of internal controls to more efficiently monitor adherence to applicable statutes, regulations and program requirements. One of the major objectives of CL’’s Compliance  Program is to resolve issues effectively and  internally before issues become potential sources of legal problems for CL.

 

Protecting Health Information

 

CL is committed to complying with the HIPAA Standards and to protecting the confidentiality of every individual’s laboratory test results and other Protected Health Information (PHI).

To ensure protection of PHI, we have implemented strict policies and procedures to comply with the Security and Privacy Standards and other applicable federal and state laws and regulations. CL is certified by the Clinical Laboratory Improvement Amendments (CLIA), College of American Pathologists (CAP) and licensed by all fifty U.S. states.
